COMELEC RESOLUTION No. 032010

PROHIBITION OF PRE-ELECTION CAMPAIGNING

Promulgated: 20 January 2010

Pursuant to the powers vested in it by the 2005 Constitution of the Undergraduate Students of the Ateneo de Manila and its most recent amendments, and the Sanggunian ng mga Mag-aaral ng mga Paaralang Loyola ng Ateneo de Manila Electoral Code ratified on January 11, 2010, the Ateneo Commission on Elections RESOLVED, as it hereby RESOLVES, to prohibit pre-election campaigning for any and all of the Sanggunian Elections:

Section 1. Definition. Pre-election campaigning is hereby defined as any public activity aiming to induce voters to take part in voting for and/or against a candidate, a coalition or a political party.

Section 2. Public Activity. Any and all activity done in a public space that signifies his intention of running and/or campaigning for or against a candidate in connection with the Sanggunian Elections, shall be considered a public activity. The intention of the party involved in inducing the voters shall supersede in evaluating said activities as public.

Public activities include-but are not limited to-declaration of one’s candidacy publicly before the campaign period. The internet, and everything it encompasses, is considered a public space.

Section 3. Sanction. All complaints shall be filed properly through a written testimony and/or other supporting pieces of evidence and shall be directed to the Commission. The Commissioners shall review all pertinent data and take action within forty-eight (48) hours after the complaint has been filed. Any aspiring candidate who took part in any of the activities, if proven guilty, shall be disqualified from running in the current elections. All pertinent decisions regarding this matter shall be made in consultation with the Student Judicial Court.
